You can receive compensation for a traumatic birth. I think the most common example that we see at our firm is either a brachial plexus injury that occurs when the providers do not timely treat shoulder dystocia. But also, there can be from a delivery using mechanical means such as a vacuum or forceps. In that case, if not done appropriately, that can lead to very catastrophic injuries such as a subdural hematoma to the child, which ultimately can cause that child to lose their life. And in fact, we are currently handling cases in which a vacuum was not applied properly by the obstetrician, which caused the hematoma to the baby and ultimately caused them to have a stroke and pass away.
