In a medical malpractice lawsuit case in Florida, the type of damages depend on whether or not it’s a personal injury or a death. So in the case of a personal injury, you have the pain and suffering and mental anguish that comes along with having the injury. You have what is known as economic damages that could include things anywhere from medical expenses to lost wages and income in the past and in the future to medical expenses going forward, having to modify someone’s house or van to be able to accommodate their injury. In the case of a wrongful death, the damages are the same as far as pain and suffering and mental anguish, but they are for the survivor of the person who passed away, not for the person who actually passed away from the medical negligence. And there’s also an income damage, but it’s not all of the income that someone has lost. It’s called net accumulations, and it’s the difference between what that person would have been able to earn versus what they would have had to spend on themselves and save. So it’s slightly different, but they’re the same general categories.
