Fortunately, in the vast majority of cases, Florida does not have a cap on either non economic or economic damages. Previously, many years ago, there was a cap, but that cap was overturned by the Florida Supreme Court. There are some cases, which is a very small percentage of cases, where the defendant can offer what is called voluntary binding arbitration, which essentially is an admission of liability, and in doing so, they can cap the non economic damages in a case. But again, that is a very small percentage. So the vast majority of cases in Florida, there is no cap on damages.
