Medical malpractice cases go to trial more often than regular negligence cases. A lot of that has to do with defendants and insurance companies and medical providers believing that jurors will have a harder time understanding the medicine and will defer to them more. But when they see that there is a plaintiff’s lawyer law firm on the other side that knows the medicine and has an experience of being willing to go to trial that is when cases are actually more likely to settle than go to trial.
