Surgical malpractice is simply surgical negligence. So people hear the word malpractice and they think it’s something above and beyond gross negligence or recklessness. But malpractice means negligence. So surgical malpractice means that the surgeon or someone on the surgical team during a surgery was negligent and fell below the standard of care that they owed the patient.
